Terms

These Terms describe the free beta service, account rules, required product analytics, complaints, and service limitations.

The Polish text is the legally authoritative version. English text is provided for convenience.

Operator

Monolith is operated by an individual in Poland/EU. Public beta contact: monolith.solution@gmail.com. Before full commercial launch, replace this placeholder with the operator's full legal name, correspondence address, phone number, and final complaint contact.

Users and legal status

The service may be used by consumers, businesses, and natural persons conducting sole-proprietor business activity. Terms limiting the Operator's liability apply to consumers and to natural-person entrepreneurs who benefit from consumer-law protections only to the extent permitted by mandatory Polish law. This includes, in particular, a natural person entering into an agreement directly connected with their business activity where the agreement is not professional in nature for that person within the meaning of Article 7aa of the Polish Consumer Rights Act.

Free beta digital service

Monolith is currently provided as a digital service in beta testing. Access may be granted, changed, or removed manually for test users. The production payment flow is not active for beta access. The beta service is provided without a monetary price, and its condition is the processing of account data, aggregated or technical data, and personal data connected with the account and usage analytics for testing, security, maintenance, and service-improvement purposes. The Privacy Notice describes the data categories, legal bases, and user rights in more detail.

Intellectual property and database rights

Monolith owns or lawfully controls the curated building-materials database, including its selection, arrangement, structure, classifications, enrichment, benchmarks, rankings, derived metadata, UI presentation, and related software. Users receive only a limited, revocable, non-transferable right to use materials data inside normal in-app workflows. Users may not copy, scrape, bulk download, reconstruct, republish, resell, train competing systems on, or create substitute databases from Monolith data. Automated access, extraction, crawling, circumvention of technical limits, and reverse engineering of the materials database are prohibited. Individual public facts, third-party EPD/source materials, and user-owned project inputs remain subject to their own rights and licenses. These Terms protect Monolith's database, curation, enrichment, arrangement, and presentation without claiming exclusive ownership over all underlying public facts.

Required account analytics

A beta account includes product-usage analytics as a condition of the service. We may track signed-in page views, feature usage, button actions, form starts, form submissions, validation errors, project lifecycle events, calculations, filters, searches, imports, exports, downloads, settings changes, access prompts, client errors, and performance timings. Data may be aggregated, technical, or personal when connected with a user account. We do not intentionally track passwords, payment details, secrets, raw project notes, raw free-text content, or full building input payloads.

Account rules

Users must provide accurate account information, protect login credentials, use the service lawfully, and avoid attempts to disrupt, scrape, reverse engineer, or access other users' data. Illegal content or abusive use may lead to account suspension or removal.

Withdrawal from the agreement

A consumer, and a natural-person entrepreneur to whom consumer-law protections apply, may withdraw from a distance agreement within 14 days without giving a reason. The withdrawal statement may be sent to monolith.solution@gmail.com from the email connected with the account or with the account email specified in the message. Withdrawal means closing or deactivating the beta account and ending access to the service. Personal data and user content are handled in accordance with the Polish Consumer Rights Act, GDPR, and the Privacy Notice, including security, accountability, claims-handling, and legal-obligation requirements.

Complaints and contact

Complaints and support requests can be sent to monolith.solution@gmail.com. Include the account email, description of the issue, relevant date, and expected resolution. The Operator reviews complaints and replies within 14 days from receipt. If a complaint is submitted by a consumer, lack of reply within that period means the complaint is accepted.

Out-of-court dispute resolution

A consumer may use out-of-court complaint and redress mechanisms, including assistance from a municipal or county consumer ombudsman, the competent Trade Inspection authority, and information provided by UOKiK at polubowne.uokik.gov.pl. A consumer may also check the current list of ADR entities published by the European Commission. The European ODR platform was closed on 20 July 2025 and is not indicated as an active complaint-submission channel.

Limitations

The user acknowledges that Monolith is in beta testing and is development-stage software. An agreed feature of the beta service is that changes, access interruptions, instability, and functional errors may occur. Calculations and presented material summaries are supportive only and should be verified each time by a person with appropriate qualifications before use in formal submissions, certification, investment decisions, or legal decisions. In business relationships, the Operator excludes liability for warranty and damages to the broadest extent permitted by law, except for damage caused intentionally. In relationships with consumers and natural-person entrepreneurs to whom consumer-law protections apply, nothing in these Terms excludes or limits rights resulting from mandatory law.
